Both combining and shortening the prayer is permissible in all travel that is customarily considered travel according to the people, as this is the correct position and it is the position of Shaykh-ul-Islaam, al-Imaam Ibn al-Qayyim and Ibn al-‘Uthaymeen.

Shortening the prayer begins when the traveller leaves his locality.  It is not permissible before leaving his locality as this is not considered ضاربا في الأرض (traversing the earth in travel) as Allah says:

{و إذا ضربتم في الارض فليس عليكم جناح ان تقصروا من الصلاة}

“And when you (Muslims) travel in the land, there is no sin on you if you shorten your Salaah (prayer).” [Soorah an-Nisaa` 4:101]

Some people make the mistake of not entering the prayer with the Imaam and waiting for the second congregation if they enter the masjid and find the Imaam in the last tashahhud. This is not correct, rather the person is to enter the prayer with the Imaam so as to get the bounty of the first jamaa’ah, especially if it is a neighbourhood masjid and the Imaam is an appointed Imaam. This is due to the difference of opinion regarding the ruling of the second jamaa'ah.

Al-Imaam Ibn al-Qudaamah mentioned in al-Mughnee (2/117): “It is not disliked to repeat the congregational prayer in the masjid. And this means that if the local imaam prays (with a group) and then another group comes, it is recommended for them to pray as a group and this is the position of Ibn Mas’ood, ‘Ataa, al-Hasan, an-Nakha'ee and others. However, Saalim, Maalik, Abu Haneefah, ash-Shaafi'ee and others stated that the congregational prayer is not repeated in a masjid which has an appointed imaam and is not on a passageway, etc. Thus, if he misses the congregation, he is to pray by himself.

There is no proof prohibiting the second congregation and that they are to pray by themselves and the hadeeth, “who will give charity to that one” is clear textual proof of its permissibility.
